UPON PAYMENT of the sum of $_________ paid by Buyer to Seller (the “Purchase Price”), receipt of which is hereby acknowledged, Seller grants, sells, conveys, and transfers ownership of the following dog (the “Dog”) to Buyer:

  1. The Buyer will register the puppy with the Continental Kennel Club (CKC). A pre-filled out CKC registration form will be given to the Buyer, upon picking up their puppy/personally delivered with the puppy.  
 

  2. The Seller guarantees that the puppy is in good health on the date of delivery. All puppies will be up to date on vaccinations, deworming, treatment to prevent heartworms, ticks, fleas, ear mites, and sarcoptic mange, they will be vet checked and have a CKC registration application. The puppy must be taken to a licensed veterinarian within 72 hours of receiving the puppy for an exam. If any concerns are found during the exam, the Seller must be notified within 24 hours.   Each puppy comes with a limited genetic health guarantee to the original Buyer. The Seller is not responsible for latent defects or other problems that occur after the puppy has reached 1 year of age. This guarantee is only for death caused by genetic defects of the heart, liver, kidneys, and lungs that occurs within the puppy’s first year. It does not cover colds, giardia, coccidian, or other parasites that are easily cured. The Buyers licensed veterinarian must provide the Seller with a written document stating the exact cause of death as verified by a copy of the necropsy. If the death was caused by a genetic defect listed above and not neglect by the Buyer, and the Sellers veterinarian agrees with the findings, the puppy will be replaced with one of equal value as soon as one is available. Cash refunds are not given after 72 hours of the date of purchase. If these terms are not met the guarantee becomes null and void.   The Seller will not be responsible for any Veterinarian expenses, or expenses incurred to have the puppy returned to the Seller. We do not guarantee size, disposition, conformation, coat, color, bite, testicles on males, or patellas once the puppy has left our premises. Hypoglycemia (low blood sugar) is not a genetic condition and is susceptible to all toy breeds. Before traveling (by plane) Nutri-cal gel is advised to be given (teaspoon) since during the flight animals are not allowed to eat or drink.

  3. Seller does not guarantee color, the adult size, conformation, reproductive ability, testicles descending, potty training ability, or the temperament of the puppy. This guarantee does not cover condition such as but not limited to an improper bite, thin coat, hernia of any kind, trachea problem, low blood sugar ( hypoglycemia), internal and external parasites, luxating patella, Grade 1 heart murmur, minor physical flaws, loose stools, coccidian, or any condition that can be corrected over time or controlled with veterinarian treatment.

  4. Seller is not responsible for the death of the puppy due to accidents, injury, neglect, hypoglycemia, dehydration, food poisoning, or any other illness that could have been prevented by the purchaser.

  5. The Seller guarantees that the puppy is free of hereditary defects to the best of his/her knowledge. The Seller does not assume any additional liability for possible genetic defects in the puppy, and will under no circumstances be responsible for veterinary bills resulting from any such condition.

  6. The Buyer shall maintain the puppy in good condition, including adherence to a regular immunization schedule, heartworm preventative, good diet, and a clean and safe environment.

  7. If at any time in its life the puppy is to be sold or given away, the Buyer shall notify the Seller. You DO agree if you cannot keep the puppy, for the lifetime of the dog, that you will return (at your expense) the puppy to the breeder and we will gladly take the puppy/dog back. You agree that you will never surrender the pup/dog to a shelter or pound, the pup/dog will be returned to us.  Initials:______   You agree that you will not ever sell nor give the puppy/dog away.   8. The Buyer shall not sell the puppy to any individual or establishment in the business of buying and selling puppies for a profit (no puppy mills, brokers, pet stores). The parties hereby agree that the Buyer will be liable for damages in the amount of $5000.00 in the event of any breach of this provision of the contract. The total amount will have to be paid immediately to the Seller.

  Shipping is NOT included in the price.

 

  9.  ENTIRE AGREEMENT. This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations, or warranties, express or implied, unless specifically stated in this Agreement.

The parties accept and agree to be bound by the attached Terms and Conditions governing the purchase and sale of the Dog.
